1. Acceptance of Terms

By accessing or using the Foodisiac platform (foodisiac.kozyhost.com), including all associated services, tools, and integrations (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms are governed by Spanish law, including the Ley 34/2002 de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE), and the Regulation (EU) 2016/679 (GDPR).

2. Description of Service

Foodisiac is a hospitality platform providing restaurant and retail businesses with tools for menu management, online ordering, reservations, staff management, social media integration, and customer engagement.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You must be at least 18 years old to register
You must provide valid business information
You must not share your credentials with unauthorized persons
You must notify us immediately of any unauthorized access

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable law, regulation, or third-party rights
Upload malicious code, viruses, or harmful content
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service's infrastructure
Use the Service for fraudulent or deceptive practices
Scrape, harvest, or collect data without authorization
Impersonate another person or entity

5. Content Ownership

Your Content: You retain ownership of all content you upload, including menus, images, business information, and customer data. By uploading content, you grant Foodisiac S.L. a limited license to process, store, and display it as necessary to provide the Service.

Platform Content: The Service, including its design, code, features, and documentation, is owned by Foodisiac S.L. and protected by intellectual property laws.

6. AI-Generated Content

The Service includes AI-powered features for content generation, document analysis, and translation. Regarding AI-generated content:

AI-generated content is provided for guidance and convenience only
You are responsible for reviewing and approving all AI-generated content before publication
AI-generated legal documents (privacy policies, terms) should be reviewed by qualified legal counsel
Foodisiac S.L. does not guarantee the legal accuracy or completeness of AI-generated content
AI processing is performed on self-hosted infrastructure; your data is not sent to external AI providers

7. Third-Party Integrations

The Service integrates with third-party platforms including Google Business Profile, Meta (Facebook/Instagram), and payment processors. You agree to comply with those third parties' terms of service when using integrations.

Foodisiac S.L. is not responsible for the availability, accuracy, or policies of third-party services.

8. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy.

Prices may change with 30 days' advance notice
Late payments may result in service suspension
You are responsible for all applicable taxes

9. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the GDPR and the Spanish LOPDGDD.

When you use the Service to process your customers' data, you act as the data controller and we act as the data processor.

10. Service Availability

Foodisiac S.L. strives to maintain high availability but does not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for temporary service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Foodisiac S.L.'s total liability for any claims arising from these Terms or the Service shall not exceed the fees paid by you in the 12 months preceding the claim.

Foodisiac S.L. is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

12. Termination

Either party may terminate the agreement at any time. Upon termination:

Your access to the Service will be revoked
You may request export of your data within 30 days
We will delete your personal data within 30 days (except as required by law)
Billing records are retained for the legally required period (6 years under Spanish tax law)

13. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through the platform at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of Spain. Any disputes shall be submitted to the courts of San Roque, Cádiz, Spain, unless mandatory consumer protection laws provide otherwise.
